The present general terms of sale are concluded between Madame Véronique Geley-librairie Oriens, autoentrepreneur, of which the head office of which is located at 229 rue de Tolbiac, 75013 Paris, Siret 534 020 755 00029, hereafter referred to as Oriens, and any other natural or artificial person wishing to make a purchase via the Oriens website, hereafter referred to as the “purchaser”.
1. PURPOSE:
The purpose of the present general terms of sale is to define the contractual relationship between Madame Véronique Geley-librairie Oriens and the purchaser, in addition to the terms applicable to all purchases made via the Oriens sales site.
The placing of any order for a book featured in the online store on the www.oriens.fr website presupposes that the present general terms of sale have been consulted and accepted beforehand.
2. THE AVAILABILITY OF BOOKS:
The books are proposed for sale subject to available stock. Although the site’s database is regularly updated, some books may be temporarily or permanently unavailable. Antique books and second-hand books in particular are generally only available as a single copy. The bookshop may not be considered liable for the non-availability of one or several books
3. ORDERS :
Any purchaser wishing to purchase a product must obligatorily:
– Confirm the contents of the “basket” for his order after having carefully checked it,
– Complete the identification form on which he should enter all of the requested information along with a password, or enter his customer identification number if he already has one and state or confirm the invoicing and delivery addresses,
– Confirm his order,
– Approve the payment.
The order confirmation constitutes unreserved acceptance of the present general terms of sale, in addition to an acknowledgement that the purchaser has fully familiarised himself with them.
All of the data supplied and the recorded confirmation will be considered as proof of the transaction. The confirmation will be considered as constituting an acceptance and signature of the transactions concerned.
The purchaser may view and print his invoice at any time, by logging into his personal account.
The information supplied by the purchaser when placing his order is binding upon the latter. The bookshop may not be considered liable if it becomes impossible to complete the order in the event of any errors with the recipient’s address or contact details.
4. PRICES :
The prices for the books featured on the site are shown in euros, inclusive of VAT in the case of new books, and excluding carriage, packaging and insurance. The carriage costs will be calculated according to the weight, destination, packaging and the insurance where applicable. The customer will be informed of these costs before confirming his order. Orders will be shipped as registered letters or packages, with the exception of orders with a value of less than 20 euros shipped to metropolitan France, which will be posted at the standard letter rate with all risks being borne by the acquirer. The prices shown may be modified at any time without notice according to changes in postal rates. However, the books will be invoiced based on the price mentioned at the time the order was placed. Orders, regardless of their source, will be invoiced and will be payable in euros only. The books will remain the property of the bookshop until payment in full of the order price.
5. PAYMENT :
The total sum to be paid by the client is that shown on the final order confirmation sent by the bookshop.
Payments by cheque, payable in France, made out in euros to Madame Véronique Geley. For cheques issued by a non-French bank, clients should add 30 euros to the total order value to cover cheque processing costs. The order will be shipped after receiving and cashing the check.
By bank transfer to Madame Véronique Geley’s account. In this case, the client should indicate the name of the person placing the order and (in the bank transfer reference) the references of the book(s) ordered. Any possible bank transfer costs will be born in full by the client.

If a book is permanently unavailable, the sum received will be refunded to the client by cheque (French customers only) or by bank transfer within the 30 days following the date on which the payment is cashed.
Orders will be accompanied by a receipted bill.
6. DELIVERY :
Orders may be shipped to all countries throughout the world with the exception of areas which are not covered by the postal services. After the payment has been cashed, the bookshop agrees to ship all of the ordered books within a maximum period of five working days. The books will be shipped to the delivery address shown on the order, in packaging specially designed to guarantee optimal protection during the transportation process.
Delivery lead times are between 3 and 8 days for metropolitan France and between 10 and 20 days abroad or for the French overseas départements and territories, except in the case of mail bags which are generally shipped by sea (around 60 days).
In order to facilitate delivery, it is vital to provide an address to which the order can be physically delivered and received during working hours. The client is required to check the condition of the packaging at the time of delivery. If the pack arrives open or damaged, he must imperatively refuse it in order for it to be returned to the bookshop, who (where applicable) may submit a claim to the postal services and the insurance company.
Books ordered from abroad are imported into the destination country under the client’s liability. It is the responsibility of the client to obtain all necessary information from the local authorities concerned and to ensure that all formalities specific to the importation of books in the destination country are completed.
7. CARRIAGE COSTS :
The total carriage costs are shown on the order acknowledgement and are subject to the buyer’s approval before each order is confirmed.
8. RIGHT OF RETRACTION :
The client has a period of seven clear days as from the date on which the order is received in order to exercise his right of retraction, with no requirement to provide grounds for this.
In order to exercise his right of retraction, the purchaser must send an e-mail to Madame Véronique Geley at contact@oriens.fr or a registered letter to the following address: Madame Véronique Geley, 229 rue de Tolbiac 75013 Paris, before returning books or other items.
Madame Véronique Geley-Librairie Oriens will issue a refund for the books returned to us in accordance with the conditions detailed above within a period of 30 days as from the date on which these are received.
The right of retraction does not apply to artificial persons.
The pack should be returned either by registered post or by Fedex or UPS only, in its original condition and accompanied by the corresponding invoice. Books damaged or soiled by the client will not be taken back.
Return carriage costs will be borne by the client.
9. LIABILITY EXCLUSIONS :
The books available for sale will be presented on the website accompanied by the information required to meet the terms of article L 111-1 of the Consumer Code which guarantees the possibility for the potential acquirer to familiarise himself with the essential characteristics of the products he wishes to acquire, prior to placing a definitive order.
The books proposed for sale meet the requirements of the applicable French legislation. The bookshop declines all liability if the delivered book does not conform to the legislation of the country to which it is delivered (regarding censorship, a ban on the sale of a particular work or of the work of a particular author, etc.). 10. INTELLECTUAL PROPERTY RIGHTS :
Oriens is a registered trademark, registered with the I.N.P.I., and Oriens.fr is a protected domain name.
The reproduction, exploitation, circulation or use the site’s constituent elements (whether visual features or sounds) is strictly forbidden for any purpose whatsoever, even partially. Any simple or hypertext link is strictly forbidden unless the express written permission of Oriens has been obtained.
11. THE PROTECTION OF PERSONAL DATA :
In conformity with the Data Protection Act of January 6, 1978, all personal data concerning purchasers may be subject to automated processing.
Oriens reserves the right to collect information concerning purchasers, including through the use of “cookies”. Purchasers may refuse the divulgence of their personal details by informing Oriens of this.
Similarly, users have a right to access and rectify any data concerning them in conformity with the law. Immediately upon request from any purchaser wishing to be removed from its database, Oriens agrees to delete all of the contact details and information concerned. No collected data may be used for any commercial purpose other than that mentioned on the site or which may be subsequently developed by Oriens.
The purchaser has a right to access, modify, rectify or delete data. In order to exercise this right, the purchaser should contact Oriens or access the login page by entering his e-mail address and password.
This site was declared to the C.N.I.L (the French data protection board), on 29.04. 2009, this declaration being recorded under the number 1361 868.
12. ARCHIVING – PROOF :
Oriens will archive the order forms and invoices on a reliable and durable medium guaranteeing a faithful copy, in conformity with the provisions of article 1348 of the Civil Code.
The Oriens bookshop’s computerised records will be considered by both parties as constituting proof of the communications, orders, payments and transactions occurring between them.
13. APPLICABLE LAW :
The present online sales terms are subject to French law.
In the event of disputes or litigation, only the courts of PARIS will be considered competent, notwithstanding multiple defendants or the introduction of third parties.
